TIPVIEW CREATOR AGREEMENT

This Creator Agreement ("Agreement") sets forth the terms between TipView ("Platform," "We," "Us") and the content provider or creator ("Creator," "Seller," "You," "Your"). By creating an account, completing verification, and uploading content, you explicitly accept these terms.

1. Eligibility

  • You confirm you are at least 18 years of age.

  • You must provide accurate, valid, government-issued identification to verify your age and identity.

  • You must provide accurate payment and tax information for revenue disbursement.

2. Nature of Content

  • The Platform facilitates the sale and distribution of tips, insights, analysis, predictions, and informational content ("Tips").

  • Tips may include, but are not limited to: sports predictions, financial analysis, investment ideas, fantasy sports advice, lifestyle recommendations, and expert insights.

  • Tips are for informational and entertainment purposes only. You acknowledge that Tips do not constitute professional financial, legal, medical, or investment advice.

3. Content Review

  • The Platform reserves the right to review content before or after publication.

  • We reserve the right to reject, remove, or suspend any content that violates Platform guidelines, applicable laws, or the terms of this Agreement.

  • Repeated violations may result in account suspension or termination.

4. Content Ownership and Licensing

  • You retain full ownership of your uploaded content.

  • You grant the Platform a worldwide, non-exclusive, royalty-free license to host, display, distribute, promote, and facilitate the sale of your content.

  • You may remove unpurchased content at any time. Content previously purchased by users remains accessible to those purchasers.

5. Accuracy and Honesty

  • You agree to provide Tips that are honest, made in good faith, and based on your genuine analysis or expertise.

  • You shall not knowingly provide false, misleading, or fabricated information.

  • You shall not guarantee specific outcomes or results. All Tips involve inherent uncertainty.

  • You shall not manipulate or misrepresent your track record, performance history, or success rates.

6. Prohibited Content and Activities You shall not upload or engage in:

  • Content that is illegal, fraudulent, or promotes illegal activity

  • Insider trading information or material non-public information regarding securities

  • Match-fixing information or content that violates sports integrity rules

  • Plagiarized content or content that infringes on third-party intellectual property

  • Spam, duplicate content, or misleading clickbait

  • Harassment, hate speech, or abusive content toward users or other Creators

  • Content depicting or involving minors in any context

  • Any scheme designed to artificially inflate earnings or deceive buyers

7. Financial and Gambling Disclaimers

  • If your Tips relate to financial markets, investments, or securities, you acknowledge you are not providing licensed financial advice unless you hold appropriate credentials and have disclosed them.

  • If your Tips relate to sports betting or gambling, you acknowledge that gambling involves risk, users should only wager what they can afford to lose, and you encourage responsible gambling practices.

  • You agree to include appropriate disclaimers with your Tips as required by the Platform.

8. Revenue and Payments

  • Revenue generated from your Tips is subject to the Platform's commission structure, as communicated in your Creator dashboard.

  • Payments will be disbursed according to the Platform's established payout schedule and minimum thresholds.

  • You are solely responsible for reporting and paying all applicable taxes on your earnings.

  • The Platform may withhold payments pending investigation of chargebacks, fraud, or policy violations.

9. Refunds and Disputes

  • The Platform may, at its discretion, issue refunds to buyers in cases of fraudulent, misleading, or non-delivered content.

  • Refunded amounts may be deducted from your pending or future earnings.

  • Excessive refund rates may result in account review, suspension, or termination.

10. Intellectual Property

  • You represent that you own or have the right to distribute all content you upload.

  • You agree not to upload content that infringes on copyrights, trademarks, or other intellectual property rights.

  • The Platform respects intellectual property rights and will respond to valid takedown requests.

11. Creator Responsibilities

  • You agree to respond to buyer inquiries in a reasonable and professional manner.

  • You agree to report any unauthorized use or infringement of your content.

  • You agree to maintain accurate profile information and credentials.

  • You agree to comply with all Platform policies and applicable laws.

12. Account Termination

  • Either party may terminate this Agreement at any time with or without cause.

  • You may close your account through your account settings or by contacting support.

  • The Platform may suspend or terminate accounts that violate this Agreement or Platform policies.

  • Upon termination:

    • Pending earnings will be disbursed according to standard payout procedures, less any amounts owed to the Platform.

    • Licenses granted herein shall terminate, except for content previously purchased by users.

    • The Platform may retain records as required by law.

13. Indemnification You agree to indemnify, defend, and hold harmless the Platform, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your content or Tips

  • Your breach of this Agreement

  • Your violation of any law or third-party rights

  • Any claim that your Tips caused financial or other harm to a buyer

14. Limitation of Liability

  • The Platform provides a marketplace service and does not guarantee the accuracy, quality, or outcomes of any Tips.

  • To the maximum extent permitted by law, the Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

  • The Platform's total liability shall not exceed the amounts paid to you in the six (6) months preceding the claim.

15. Amendments

  • The Platform reserves the right to modify this Agreement at any time.

  • Material changes will be communicated via email or Platform notification.

  • Continued use of the Platform after changes constitutes acceptance of the updated terms.

16. Governing Law and Disputes

  • This Agreement shall be governed by the laws of the State of Florida, United States.

  • Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

  • You waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Severability If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement This Agreement constitutes the entire agreement between you and the Platform regarding your role as a Creator and supersedes all prior agreements or understandings.
